Do I need a lawyer for a car accident claim?
Not every car accident requires an attorney. But for some claims, having one can make a meaningful difference. Here is how to think about the decision.
When you can often handle it yourself
- The accident was minor with little or no injury.
- Fault is clear and undisputed.
- Your medical costs are small and you have fully recovered.
- The insurer's offer already looks fair against your documented costs.
In these situations many people negotiate directly with the insurance company, using their bills and a tool like our settlement calculator to sanity-check the offer.
When a lawyer usually helps
- Serious or lasting injuries. Higher stakes mean bigger gaps between a fair settlement and a low offer.
- Disputed fault. If the other side blames you, an attorney can help establish liability.
- Multiple parties or unclear insurance. Complex cases benefit from experience.
- A lowball offer. If the insurer won't move, legal pressure can change the math.
How personal injury fees usually work
Most personal injury attorneys work on a contingency fee: they take a percentage of the settlement (commonly around a third) only if they win, so there is typically no upfront cost. Many offer free consultations, which can be a low-risk way to understand your options.
Questions to ask in a consultation
- Have you handled cases like mine, and what were the outcomes?
- What is your fee, and what expenses come out of the settlement?
- What is a realistic range for my claim, and how long might it take?
